You have a strict 5-month window to apply for OPT. Missing this window means losing your opportunity.

Critical Rule: USCIS must receive your application within 30 days of your DSO recommending OPT in SEVIS. Do not request the I-20 too early if you aren't ready to mail/file.

2The "Red Zone" (How to Lose It)

90 Days Unemployment

You have a cumulative total of **90 calendar days** of unemployment during your 12 months. Weekends and holidays count if you are unemployed.

Other Ways to Lose Status

  • Unauthorized Work: Working < 20 hours/week or in a job unrelated to your major.
  • Starting School: Transferring to a new school or starting a new degree program automatically terminates OPT.
  • Reporting Failures: Failing to report address or employer changes within **10 days** via the SEVP Portal.

Critical Checklist

  • Form I-765 (Completed Online/Paper)
  • NEW I-20 with OPT Recommendation (Page 2)
  • Passport Biographic Page + Visa Stamp
  • Most recent Form I-94
  • 2 Passport-Style Photos (2x2 inches)
  • Previous CPT/OPT I-20s (All of them)

Fatal Error: Do not file I-765 without the new OPT I-20 from your DSO. USCIS will deny your application and keep your money.

5Travel Risk Assessment

Status: Pending

HIGH RISK

Do not travel. If your application is approved while you are abroad, you cannot re-enter without the physical EAD card. If denied, you cannot re-enter at all.

Approved (No Job)

MEDIUM RISK

Risky. CBP may question your intent. Carry evidence of active job search (interviews, applications). Re-entry is at officer discretion.

Approved (With Job)

LOW RISK

Generally safe. You MUST carry: Valid Passport, F-1 Visa, EAD Card, I-20 (Travel Signature < 6 months), and Employment verification letter.

6The "Cap-Gap" Relief

Bridging the Gap

If your employer files a "Change of Status" H-1B petition strictly before your OPT expires (or during your 60-day grace period), your F-1 status and work authorization are automatically extended to September 30th.
